Le processus est d\u00e9mocratique lors des r\u00e9unions.\u00a0 Bien que la plupart des d\u00e9cisions quotidiennes soient prises par le Conseil ou le gestionnaire, tous les copropri\u00e9taires peuvent participer \u00e0 l&rsquo;\u00e9lection des membres du conseil qui va les repr\u00e9senter, Cependant, il arrive souvent que les propri\u00e9taires ne puissent pas assister aux r\u00e9unions pour diverses raisons, notamment le fait qu&rsquo;ils peuvent \u00eatre absents ou malades le jour de la r\u00e9union.<\/p>\n<p>Pour la raison ci-dessus et parce que chaque Assembl\u00e9e G\u00e9n\u00e9rale d\u2019un Syndicat requiert un quorum, des proc\u00e9dures de procuration sont g\u00e9n\u00e9ralement mises en place afin de faciliter le processus. Dans cet article, nous explorons les principes fondamentaux des votes par procuration dans les copropri\u00e9t\u00e9s.<br \/>\n\u200d<\/p>\n<figure class=\"w-richtext-align-center w-richtext-figure-type-image\">\n<div><img decoding=\"async\" src=\"https:\/\/www.condomanager.com\/images\/condo%20proxy%20voting.jpg\" alt=\"\" \/><\/div>\n<\/figure>\n<h4>Qu&rsquo;est-ce qu&rsquo;un vote par procuration?<\/h4>\n<p>En termes simples, une procuration est un document qui permet \u00e0 un copropri\u00e9taire de nommer quelqu&rsquo;un pour le repr\u00e9senter lors d&rsquo;une r\u00e9union des copropri\u00e9taires. Cela signifie que si un copropri\u00e9taire ne peut pas assister \u00e0 une Assembl\u00e9e G\u00e9n\u00e9rale, le mandataire peut le remplacer et voter au nom du copropri\u00e9taire qu\u2019il repr\u00e9sente.<\/p>\n<p>Son objectif est double:<\/p>\n<p>&#8211; Voter: le but des procurations est essentiellement de pouvoir voter sans \u00eatre pr\u00e9sent.<br \/>\n&#8211; Atteindre le quorum: au Qu\u00e9bec, les r\u00e9unions des copropri\u00e9taires, pour \u00eatre valides, doivent avoir\u00a0 50% et plus de votants (que ce soient en personne ou par procuration, ce que l\u2019on appelle couramment le quorum).<\/p>\n<p>M\u00eame si ce n\u2019est pas le but de cette chronique, soulignons qu\u2019il y a certaines r\u00e8gles qui permettent une r\u00e9union alors que le quorum n\u2019est pas atteint et que le pourcentage de votes requis pour certains r\u00e8glements requiert un pourcentage plus \u00e9lev\u00e9. \u00a0 Nous en reparlerons dans une autre chronique.<\/p>\n<p>\u200d<\/p>\n<h4>Qui peut \u00eatre mandataire?<\/h4>\n<p>Ce n&rsquo;est pas compliqu\u00e9. Essentiellement, n&rsquo;importe qui peut \u00eatre mandat\u00e9 pour voter par procuration. La seule condition est que ce soit une personne physique qui puisse \u00eatre pr\u00e9sente \u00e0 la r\u00e9union des copropri\u00e9taires. Il n&rsquo;y a aucune exigence qu&rsquo;un mandataire soit un copropri\u00e9taire. Les mandataires les plus typiques que nous avons vus sont le conjoint, un autre copropri\u00e9taire, le voisin, le locataire, un ami ou un membre de la famille.<\/p>\n<p>\u200d<\/p>\n<h4>Comment fonctionnent les procurations (souvent appel\u00e9es par leur terme anglais \u2018proxy\u2019) ?<\/h4>\n<p>Premi\u00e8rement, la personne qui signe la procuration doit \u00eatre le copropri\u00e9taire qui poss\u00e8de le droit de vote.
