Nous voulions profiter de cette occasion pour discuter plus sp\u00e9cifiquement d&rsquo;un aspect de la gestion des copropri\u00e9t\u00e9s qui a \u00e9t\u00e9 soulev\u00e9 souvent r\u00e9cemment par les gestionnaires: les assembl\u00e9es g\u00e9n\u00e9rales annuelles.<\/p>\n<p>R\u00e9cemment, les gouvernements du Qu\u00e9bec et de l&rsquo;Ontario sont all\u00e9s de l&rsquo;avant en suspendant les d\u00e9lais obligatoires pour les assembl\u00e9es annuelles tout en autorisant les r\u00e9unions virtuelles et le vote. Nous pensons que d&rsquo;autres juridictions feront de m\u00eame en Am\u00e9rique du Nord, si cela n&rsquo;a pas d\u00e9j\u00e0 \u00e9t\u00e9 fait.<\/p>\n<p>\u00c9tant donn\u00e9 les d\u00e9veloppements et l&rsquo;incertitude entourant le coronavirus, nous avons estim\u00e9 que le moment est opportun pour vous aider \u00e0 assurer le bon d\u00e9roulement des r\u00e9unions virtuelles. Voici une liste de points \u00e0 v\u00e9rifier avant la r\u00e9union virtuelle des copropri\u00e9taires. (Remarque: chaque juridiction a des lois diff\u00e9rentes sur la fa\u00e7on dont les r\u00e9unions doivent \u00eatre tenues, il est donc important de consulter les lois locales. Il existe encore des juridictions qui n&rsquo;autorisent pas officiellement les r\u00e9unions virtuelles).<\/p>\n<p>\u200d<\/p>\n<figure class=\"w-richtext-align-center w-richtext-figure-type-image\">\n<div><img decoding=\"async\" src=\"https:\/\/www.condomanager.com\/images\/condo%20empty%20meeting%20room.jpg\" alt=\"\" \/><\/div>\n<\/figure>\n<h5>\u200d<\/p>\n<p>1. \u00c9tablissement de la liste des participants<\/h5>\n<p>Ce qui est important, (que ce virtuel ou en personnes), c\u2019est qu\u2019il doit y avoir un contr\u00f4le des copropri\u00e9taires aptes \u00e0 participer \u00e0 la r\u00e9union.\u00a0 Rappelez-vous que m\u00eame si leur droit de vote peut avoir \u00e9t\u00e9 r\u00e9voqu\u00e9 (ex. s\u2019ils sont en retard de plus de 90 jours dans leurs paiements des charges communes ou pour d\u2019autres raisons), que ce n\u2019est pas parce qu\u2019un copropri\u00e9taire n\u2019a plus le droit de voter qu\u2019il n\u2019a pas le droit de participer \u00e0 la r\u00e9union.<\/p>\n<p>\u200d<\/p>\n<h5>2. Gestion des procurations (proxy)<\/h5>\n<p>Les copropri\u00e9taires ont le droit de donner une procuration \u00e0 quelqu\u2019un d\u2019autre pour les repr\u00e9senter (en personne ou virtuellement).\u00a0 C\u2019est avec cette liste des copropri\u00e9taires aptes \u00e0 participer (ou via leur mandataire) que le contr\u00f4le des \u2018pr\u00e9sences\u2019 sera exerc\u00e9 lors de la r\u00e9union.<\/p>\n<p>Au-del\u00e0 de la simple classification des titulaires de procuration, il existe un processus de certification qui doit \u00eatre respect\u00e9 afin de garantir le respect des r\u00e8gles relatives \u00e0 l&rsquo;identification des copropri\u00e9taires ou de leur mandataire. Cela peut \u00eatre fait par courriel et via un syst\u00e8me d\u2019archivage sp\u00e9cifique de copies authentifi\u00e9es.<\/p>\n<p>Toutes les plates-formes de r\u00e9unions virtuelles n&rsquo;ont pas n\u00e9cessairement les fonctionnalit\u00e9s qui r\u00e9pondent pr\u00e9cis\u00e9ment \u00e0 la gestion de l&rsquo;inscription des participants.<\/p>\n<p>Comme il ne peut y avoir de contr\u00f4le physique, il faut donc que les participants l\u00e9gitimement enregistr\u00e9s obtiennent un mot de passe pour participer \u00e0 r\u00e9union virtuelle.<\/p>\n<p>\u200d<\/p>\n<h5>3. Avis de convocation<\/h5>\n<p>L&rsquo;avis de convocation requiert des informations telles que l\u2019ordre du jour, les r\u00e9solutions qui y seront propos\u00e9es, les rapports financiers et le prochain budget annuel.\u00a0 Les documents pertinents peuvent \u00eatre exp\u00e9di\u00e9s par courriel, ce qui \u00e9vite les contacts physiques.\u00a0 Surveillez \u00e9galement les d\u00e9lais entourant les avis de convocation par rapport \u00e0 la fin de l\u2019ann\u00e9e financi\u00e8re et des sujets \u00e0 ajouter \u00e0 l\u2019ordre du jour que les copropri\u00e9taires peuvent faire ajouter suite \u00e0 l\u2019avis de convocation. Il faut donc conna\u00eetre et respecter les d\u00e9lais inscrits dans les r\u00e8glements et les lois.\u00a0 Ce n\u2019est pas parce que la r\u00e9union a lieu virtuellement, que ces d\u00e9lais ne s\u2019appliquent plus.\u00a0 Le non-respect des d\u00e9lais l\u00e9gaux pourrait rendre la r\u00e9union invalide.<br \/>\n\u200d<\/p>\n<h5>4. Gestion du quorum<\/h5>\n<p>Le quorum peut \u00eatre un aspect important de la gestion des r\u00e9unions (virtuelles ou non). Le quorum doit \u00eatre :<\/p>\n<p>Calcul\u00e9 et signifi\u00e9 aux participants apr\u00e8s validation par le pr\u00e9sident et le secr\u00e9taire de l\u2019assembl\u00e9e et maintenu tout au long d&rsquo;une r\u00e9union (en cas de rupture du quorum, la r\u00e9union peut continuer \u00e0 moins que des copropri\u00e9taires exigent d\u2019y mettre fin).<\/p>\n<p>La bonne utilisation des outils \u00e9lectroniques peut \u00eatre une solution efficace pour cette t\u00e2che. C\u2019est d\u2019ailleurs une fonction appr\u00e9ci\u00e9e du logiciel Condo Manager.\u00a0 Pour une application \u2018en ligne\u2019, des logiciels tels que GetQuorum peuvent \u00eatre utiles aussi. Le plus important est que les r\u00e8glements administratifs imposent certaines conditions pour appliquer et maintenir un quorum. Le produit logiciel utilis\u00e9 doit \u00eatre personnalisable dans ces conditions variables.<\/p>\n<p>\u200d<\/p>\n<h5>5. Traitement des votes<\/h5>\n<p>\u00c9tant donn\u00e9 que la r\u00e9union se tient en ligne, il n&rsquo;y aura \u00e9videmment pas de carte de vote. Il doit donc y avoir une m\u00e9thode l\u00e9gale en remplacement. De nos jours, les outils \u00e9lectroniques qui permettent les r\u00e9unions virtuelles ont la possibilit\u00e9 d&rsquo;enregistrer les votes. Ils sont assez simples et \u00e9galement assez pr\u00e9cis.<\/p>\n<p>Rappelons que tous les participants autoris\u00e9s n\u2019ont n\u00e9cessairement le droit de vote (voir plus haut).<\/p>\n<h5>\u200d<br \/>\n6. Compte rendu de r\u00e9union<\/h5>\n<p>Les syst\u00e8mes plus \u00e9labor\u00e9s ont des fonctionnalit\u00e9s pour enregistrer les r\u00e9unions virtuelles. C&rsquo;est une fonctionnalit\u00e9 tr\u00e8s puissante et utile car elle permet au conseil d\u2019administration de documenter les choses afin d&rsquo;\u00e9viter de futurs conflits.<\/p>\n<p>La seule chose \u00e0 surveiller dans ce cas, c\u2019est d&rsquo;obtenir le consentement pr\u00e9alable des propri\u00e9taires au d\u00e9but de la r\u00e9union pour que l&rsquo;enregistrement de la r\u00e9union soit reconnu l\u00e9galement.<\/p>\n<p>\u200dChez Condo Manager, nous esp\u00e9rons que vous restez en s\u00e9curit\u00e9 et que cette mauvaise p\u00e9riode sera bient\u00f4t derri\u00e8re nous.
