Cette nouvelle loi concerne la vente de propri\u00e9t\u00e9s r\u00e9sidentielles et plus particuli\u00e8rement, la copropri\u00e9t\u00e9 divise. Son objectif est d&rsquo;offrir un cadre am\u00e9lior\u00e9 aux copropri\u00e9taires en modifiant plusieurs articles du Code civil du Qu\u00e9bec. La nouvelle loi au Qu\u00e9bec a un impact important pour les propri\u00e9taires de condos de la province. Nous en discutons dans cet article.<\/p>\n<p>&nbsp;<\/p>\n<figure class=\"w-richtext-align-center w-richtext-figure-type-image\">\n<div><img decoding=\"async\" src=\"https:\/\/www.condomanager.com\/images\/pexels-celine-chamiotponcet.jpg\" alt=\"\" \/><\/div>\n<\/figure>\n<p>La nouvelle loi am\u00e9liore de nombreuses choses concernant les condos et a \u00e9t\u00e9 largement consid\u00e9r\u00e9e comme une \u00e9volution positive. Les plus notables sont les suivants:<\/p>\n<ul role=\"list\">\n<li>\u00c9tablit un cadre pour am\u00e9liorer la communication et la transparence entre le conseil d&rsquo;administration et les propri\u00e9taires.<\/li>\n<li>Exiger des propri\u00e9taires qu&rsquo;ils cr\u00e9ent un fonds de pr\u00e9voyance et m\u00e8nent une \u00e9tude tous les cinq ans afin d&rsquo;assurer la sant\u00e9 du fonds.<\/li>\n<li>Meilleure protection des montants d&rsquo;achats pay\u00e9s par les propri\u00e9taires aux promoteurs de condos.<\/li>\n<\/ul>\n<p>Des am\u00e9liorations en mati\u00e8re de communication \/ transparence ainsi que des plans financiers plus sophistiqu\u00e9 sont \u00e9t\u00e9 mis en place pour prot\u00e9ger les propri\u00e9taires de condos alors que laprovince reconna\u00eet l&rsquo;essor des condos dans la province.<\/p>\n<p>&nbsp;<\/p>\n<h5>Communication et transparence<\/h5>\n<p>La nouvelle loi impose aux conseils d&rsquo;administration le fardeau de maintenir une communication plus structur\u00e9e avec tous ses propri\u00e9taires. Ce nouveau cadre de communication n\u00e9cessitera une meilleure tenue des dossiers et un meilleur acc\u00e8s aux documents. Voici quelques points importants:<\/p>\n<ul role=\"list\">\n<li>Registre des informations des propri\u00e9taires: Le syndicat sera tenu de tenir un registre contenant les noms et adresses de tous les propri\u00e9taires et locataires. \u00c0 leur tour, les propri\u00e9taires auront acc\u00e8s pour consulter ce registre sur demande.<\/li>\n<li>Registre des documents officiels: Les documents officiels relatifs au syndicat doivent \u00e9galement \u00eatre conserv\u00e9s et accessibles. Cela comprend les proc\u00e8s-verbaux des r\u00e9unions des propri\u00e9taires et des r\u00e9unions du conseil, les r\u00e9solutions, les r\u00e8glements administratifs et les \u00e9tats financiers. Les autres documents soumis \u00e0 cette exigence sont la d\u00e9claration de copropri\u00e9t\u00e9, les contrats avec les vendeurs, le plan cadastral, les registres d&rsquo;entretien, les \u00e9tudes de fonds de pr\u00e9voyance et autres.<\/li>\n<li>Notification aux propri\u00e9taires des d\u00e9cisions: Le conseil d&rsquo;administration est d\u00e9sormais tenu, dans les 30 jours suivant une r\u00e9union, d&rsquo;aviser les propri\u00e9taires des r\u00e9unions tenues par le conseil et des r\u00e9solutions adopt\u00e9es. S&rsquo;il y a une d\u00e9cision qu&rsquo;un propri\u00e9taire veut contester, il a le droit de le faire en s&rsquo;adressant au tribunal.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h5>Fonds de pr\u00e9voyance<\/h5>\n<p>Tout comme dans d&rsquo;autres provinces, la nouvelle loi a rendu obligatoire pour les syndicats de maintenir un fonds de pr\u00e9voyance afin d&rsquo;avoir un des fonds pour les d\u00e9penses impr\u00e9vues. Ces d\u00e9penses comprennent des choses telles que la r\u00e9paration des b\u00e2timents et les travaux sur les aires communes ou les urgences.<\/p>\n<p>Il existe certaines conditions pour que le Fonds soit liquide et accessible dans un court laps de temps.<\/p>\n<p>Un autre aspect important du Fonds est que tous les cinq ans, une \u00e9tude soient reprise afin de v\u00e9rifier et de s&rsquo;assurer que le Fonds est en bonne sant\u00e9.Les \u00e9tudes sont men\u00e9es par un membre d&rsquo;un ordre\u00a0professionnel.<\/p>\n<p>\u200d<\/p>\n<h5>L&rsquo;information financi\u00e8re<\/h5>\n<p>Les propri\u00e9taires ne resteront en th\u00e9orie plus \u00e0 l&rsquo;\u00e9cart. Le conseil d&rsquo;administration est tenu de prendre des mesures pour accro\u00eetre la transparence avec les propri\u00e9taires des finances du condo. Non seulement les informations importantes sur le syndicat doivent \u00eatre communiqu\u00e9es en temps voulu aux propri\u00e9taires, mais la documentation et les registres doivent \u00eatre conserv\u00e9s et accessibles aux propri\u00e9taires.<\/p>\n<p>\u200d<\/p>\n<h5>Exigences technologiques en vertu de la nouvelle loi<\/h5>\n<p>Bien que la loi n&rsquo;oblige pas explicitement les syndicats \u00e0 utiliser la technologie pour r\u00e9aliser tous ces changements, utiliser un logiciel pour se conformer serait la chose \u00e9vidente \u00e0 faire.
